Welcome to Your Bazaar! By accessing or using the Your Bazaar online Platform, either on the website or mobile applications, you confirm that you have read and understood, and agree to be bound by these Terms of Use. If you do not agree with these Terms of Use, then please do not use the Platform.

  1. Definitions

    1. "Platform" - refers to the Your Bazaar website and mobile applications.

    2. "User" - refers to any individual who uses the Platform, including Sellers and Buyers.

    3. "Seller" - refers to any User who lists a product for sale on the Platform.

    4. "Buyer" - refers to any User who purchases a product listed on the Platform.

    5. "Applicable Law" - means any and all laws, decrees, ministerial decisions, statutes, statutory instruments, orders, regulations, resolutions, directive, treaties or other such instrument enforced as law in the United Arab Emirates.

  2. User Accounts

    1. "Registration" - Users must create an account to list or purchase products. All information provided must be accurate and kept up-to-date.

    2. "Account Security" - Users are responsible for maintaining the confidentiality of their account information and password. Users agree to notify Your Bazaar immediately of any unauthorized use of their account.

    3. "User Age" - Users must be at least eighteen (18) years of age, in the case of an individual, and legally capable of entering into a contract.

    4. "Verified User" - Users must provide legally valid documentation and identification when registering as a Verified User.

    5. "Applicable Laws" - Users must comply with Applicable Laws, and shall not use the Platform for any use which may contravene Applicable Laws.

  3. Listing Items

    1. "Eligibility" - Only Users who have registered an account may list products for sale.

    2. "Item Listings" - Sellers must provide accurate and complete information about the products they list, including but not limited to the condition, price, and any relevant details. Misleading or fraudulent listings are strictly prohibited and may be reported to the relevant authorities.

    3. "Item Descriptions" - Sellers must provide true and accurate descriptions of the items listed, otherwise a Seller will risk the item being returned through the disputes process. If a seller is found to be at fault for not properly and accurately describing the attributes of an item listing, then the Seller will be liable for the delivery costs of returning the item, and any other costs which may be deemed reasonable due to Seller’s fault.

    4. "Prohibited Items" - Your Bazaar prohibits the sale of illegal or prohibited items, as well as items that violate our community guidelines. This includes items such as weapons, drugs, counterfeit goods, and adult content.

    5. "Listing Approval" - Your Bazaar will review and approve each listing before it is posted on the Platform, and all items must be in accordance with Applicable Laws and Your Bazaar's policy of prohibited items.

  4. Buying Products

    1. "Your Bazaar Online Transaction" - When a Buyer and Seller opt to transact using Your Bazaar’s online transaction service, Your Bazaar will provide a protected payment service using its trusted payment partner. This service is provided for a fee and offers protection to the Buyer to safely make a payment for the purchase, which will be held securely until expiry of the complaints period, after which the purchase price will be released to the Seller, less any additional fees.

    2. "Purchase Agreement" - When a Buyer places an order using Your Bazaar’s purchase protection service, Buyer is entering into a binding agreement to purchase the item from the Seller.

    3. "Payment" - Buyers must pay for the products using the payment methods provided by the Platform. All transactions are processed securely by Your Bazaar’s trusted payment partner.

    4. "Delivery" - Your Bazaar offers a delivery service which will facilitate collection of the Seller’s item and delivery to the Buyer through its trusted delivery partner(s). Delivery times may vary based on location and other factors, which will be notified to Sellers and Buyers in accordance with the delivery partner’s schedule and Terms and Conditions.

    5. "Online Transactions" - Payments using Your Bazaar’s online transaction service will be governed by the Terms and Conditions of Your Bazaar’s payment partner.

    6. "Offline Transactions" - Sellers and Buyers may opt to transact directly, not using Your Bazaar’s online transaction service or delivery options. When Sellers and Buyers opt to transact directly, Your Bazaar shall not be responsible or liable for any aspect of the offline transaction.

  5. Fees and Payments

    1. "Seller Fees" - Your Bazaar may charge Seller fees for listing products and for completed transactions. Details of these fees will be provided at the time of listing.

    2. "Payment Processing" - Payments are processed through secure third-party payment processors. Your Bazaar does not store any payment information.

  6. Returns and Refunds

    1. "Return Policy" -  

      Yes, through Your Bazaar and Trustap’s return procedure, a buyer can request to submit a return if an item received is not as per description of the listing. 
      Note: A return will only be accepted if the buyer can demonstrate clearly that the item is significantly different from its description and/or faulty.

      Buyers may return products in accordance with Your Bazaar’s return policy. Specific return conditions and procedures will be outlined in the return policy section.

    2. "Refunds" - Refunds will be processed to the Buyer once the returned item is received and inspected. Refunds may take several business days to appear in the Buyer’s account.

  7. User Conduct

    1. "Prohibited Activities" - Users may not engage in any activity that is harmful, fraudulent, or illegal. This includes, but is not limited to, harassment, impersonation, or attempting to manipulate the platform.

    2. "Reporting Violations" - Users are encouraged to report any violations of these terms to Your Bazaar.

  8. Intellectual Property

    1. "Ownership" - All content on the Platform, including text, graphics, logos, and images, is the property of Your Bazaar or its content suppliers and is protected by intellectual property laws.

    2. "User Content" - By posting content on the Platform, Users grant Your Bazaar a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute the content.

    3. "Trademark" - 

      Your bazaar is a registered trademark under the laws of UAE.

  9. Limitation of Liability

    1. "No Warranty for Use" - Your Bazaar provides the Platform on an "as is" and "as available" basis. We do not warrant, either expressly or implied, that the Platform will be uninterrupted, secure, or error-free.

    2. "No Warranty for Items" - Your Bazaar is an online marketplace which provides a platform for private Sellers and private Buyers to sell and buy used, pre-loved, unused or new items. Your Bazaar is not a supplier, manufacturer or distributor of the items listed on the platform, and therefore does not warrant, whether expressly or implied, the quality, functionality, or fitness for intended use of any item.

    3. "Liability" - Your Bazaar is not liable for any direct, indirect, incidental, or consequential damages arising out of or in connection with the use of the Platform.

    4. "No Liability for Shipping" - 

      Delivery are fulfilled by your bazaar’s delivery partners and your bazaar is not liable for any damaged items, either in transit or otherwise. Damage in transit will be subject to delivery partner’s terms and conditions.

  10. Indemnification

    Users agree to indemnify and hold Your Bazaar harmless from any claims, damages, or expenses arising from their use of the Platform or violation of these terms.

  11. Modifications

    Your Bazaar reserves the right to modify these Terms of Use at any time. Users will be notified of any significant changes and continued use of the Platform constitutes acceptance of the revised terms.

  12. Governing Law

    These Terms of Use are governed by and construed in accordance with the laws of the United Arab Emirates, as applied in the Emirate of Dubai. Any disputes arising out of these terms will be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates, UAE.
